Minister of Interior issues decision regulating electronic resolution of rental disputes

Muscat: The Minister of Interior has issued a new decision outlining the regulatory framework for resolving rental disputes electronically in the Sultanate of Oman. The decision aims to streamline and digitize the dispute resolution process between landlords and tenants of residential, commercial, and industrial properties.

Key Provisions of the Decision:

- Definitions and Scope: The decision defines key terms such as the Rental Dispute Resolution Committee, the application for dispute resolution, and the electronic system designated for submitting and processing such applications.

- Electronic Submission: Applications may be submitted through the designated electronic system, accompanied by required documents including contact details of the disputing parties, proof of payment of applicable fees, and legal representative information where applicable.

- Digital Procedures: All procedures and documents related to the dispute will be recorded electronically. Access to these records is restricted and requires authorization from the committee chair. Proceedings will be documented digitally without the need for physical signatures.

- Hearing Notifications: The committee secretary is responsible for registering the application in the electronic system and notifying the parties of the hearing date within seven days of submission. If electronic notification is not possible, traditional methods under the Civil and Commercial Procedures Law will apply.

- Document Exchange: All submissions, responses, and supporting documents must be filed and exchanged through the electronic system. If this is not feasible, alternative legal procedures will be followed.

- Personal Appearance: The committee chair may require parties to appear in person if necessary. Parties may also request to appear in person via the electronic system, and the committee must respond within seven working days.

- Legal Validity
 Electronic documents and committee decisions will carry the same legal weight as official and customary written documents, provided they meet the conditions stipulated in the Electronic Transactions Law.

This decision marks a significant step toward enhancing efficiency, transparency, and accessibility in the resolution of rental disputes in Oman through digital transformation.
